Terms of service

Effective 23 September 2026 · Last updated 23 September 2026

Controlled pre-launch. These terms cover evaluation access only. Kapel's commercial catalog, paid customer access, refunds, credit expiry, service levels, and consumer or professional eligibility are not active and will require separate published terms before launch.

1. Operator

Kapel.ai is an auto-entreprise operating from Paris, France. The complete legal identity and postal address will be published before commercial activation. Contact: [email protected].

2. The service

Kapel develops API and dashboard infrastructure for AI inference safety, including classification of supported image-generation prompts. Pre-launch features may change, be unavailable, or be withdrawn and must not be relied upon for safety-critical decisions.

3. Accounts

You must provide accurate information, protect your account and API credentials, and promptly report suspected compromise. Customer login may use Google or GitHub. You remain responsible for activity performed through credentials issued to your organization.

4. Acceptable use

You must not use Kapel to violate law or third-party rights; probe, disrupt, overload, or bypass service protections; gain unauthorized access; conceal abusive automation; resell evaluation access without permission; or treat a probabilistic classification as a legal determination or guarantee. We may restrict access to protect users, infrastructure, or third parties.

5. Your content

You retain rights in content you submit. You grant Kapel the limited right to process it solely to provide, secure, and troubleshoot the requested service. You represent that you have the rights and lawful basis needed to submit that content.

6. Kapel materials

Kapel and its licensors retain rights in the service, software, models, documentation, branding, and related materials. No ownership transfers under these terms.

7. Availability and changes

Pre-launch access is provided without a service-level commitment. Maintenance, provider failures, security events, capacity limits, and product changes may interrupt access. Kapel may change limits or discontinue evaluation features.

8. No warranties

To the extent permitted by law, evaluation access is provided “as is” and “as available.” Machine-learning output can be incorrect, incomplete, or inconsistent. You must apply appropriate human review and safeguards for your use case. Mandatory statutory rights remain unaffected.

9. Liability

Nothing excludes liability that cannot lawfully be excluded. Subject to that rule, Kapel is not responsible for indirect or consequential loss arising from free pre-launch evaluation access. Commercial liability limits will be stated in the terms applicable when paid service launches.

10. Suspension and termination

You may stop using evaluation access at any time. Kapel may suspend or terminate access for security risk, abuse, legal requirements, breach of these terms, or discontinuation of the preview. Data is handled according to the privacy notice.

11. Governing law

These terms are governed by French law. Mandatory consumer protections and jurisdiction rules applicable to you are not displaced. Any dispute should first be raised with [email protected].

12. Changes

We may update these terms as the service develops. A revised effective date will be published here. Material commercial changes will not apply retroactively unless required by law or accepted by the customer.
